General Rental Terms
Effective from 1st April 2024

ENGLISH VERSION

1. General Provisions and Scope :
This document governs the rental conditions of the Pavillon Gallatin and its annexes located at Route de Pregny, 1292 Pregny-Chambésy, represented by “the owner” PENTHES Sàrl, Avenue de Châtelaine 36, 1203 Geneva.
2. Rental Duration :
The rental duration is specified in the rental quote. The tenant undertakes to strictly adhere to the agreed-upon schedules and to vacate the premises at the end of the rental period.
3. Rental Rate, Payment and Reservation :
The rental rate is specified in the rental quote and payment must be made according to the agreed-upon terms.
Reservation is effective upon receipt of full payment and thus generates the rental contract. Any late payment may result in cancellation of the option or late penalties.
4. Subletting :
Any subletting of the premises assigned to the organizer is prohibited, except with the prior written consent of PENTHES Sàrl.
5. Use of the Venue :
The tenant agrees to use the venue only for the agreed-upon purposes and solely for private events. Any contrary usage is strictly prohibited. The tenant is responsible for ensuring that the event complies with applicable legal and regulatory standards. Hanging decorations and suspending technical equipment are strictly prohibited without the owner’s consent.
6. Event Hours and Noise Disturbances:
The tenant is responsible for adhering to the schedule and maintaining neighborhood tranquility. For festive events, music may be played until:
– 10:00 PM outdoors
– 2:00 AM indoors
During the event, the sound volume must be limited to 93 dBa averaged over 1 hour on the dance floor.
After 2:00 AM, music may be played at a maximum sound volume of 80 dBa averaged over 1 hour.
In case of violation, the tenant is responsible for the consequences. Any violation reported to the authorities by a third party after the event may be reported to the competent authority.
7. Responsibilities:
The owner disclaims any liability for damages to the client’s property or to third parties during the rental period.
The tenant is required to obtain liability insurance covering the event. Any damage must be reported no later than upon the return of the rented premises.
8. Safety and Fire Safety :
The venue’s capacity is 300 people. In case of overcapacity, the owner disclaims any liability. The tenant is responsible for order, security, and fire safety during the rental period.
Fireworks and pyrotechnic devices are prohibited.
9. Cancellation :
In case of cancellation by the tenant, the following conditions apply:
• Up to 121 days before the event : 50% of the rental rate is due
• 120 days before the event : 100% of the rental rate is due
In case of cancellation by the venue owner for reasons beyond their control, the client will be entitled to a full refund of the amounts paid.
10. Cleaning and Waste Management :
Cleaning of the premises after the event is detailed and quoted in the rental offer based on the type and duration of the event. However, the tenant shall ensure the collection and removal of waste from the Pavillon Gallatin, within the event perimeter around the Pavillon Gallatin, garden and parking area.
Waste must be collected and removed upon return of the venue. Any failure may result in additional cleaning fees.
11. Return of Premises :
The tenant is obliged to return the premises in the condition resulting from a use consistent with the contract. Any breach of this obligation will result in renovation costs.
12. Contract Modification :
Any modification of the rental contract must be agreed upon in writing between the parties.
13. Applicable Law and Jurisdiction :
These general conditions are available in French and English. In case of discrepancy between the two versions, the French version prevails. These general conditions are governed by Swiss law. The jurisdiction is in Geneva.
The tenant agrees to comply with these general rental conditions and any other directives unconditionally.
